General Terms and Conditions (AGB) - Krisztina Oláhné Balla/KRIANDALA

Status: 01.03.2026.

1. Scope of Application

These General Terms and Conditions (AGB) apply to all contracts concluded via www.kriandala.com between me, Krisztina Oláhné Balla, 7350 Oberpullendorf, AUSTRIA – hereinafter "Artist" – and you as a buyer or client – hereinafter "Client".

2. Conclusion of Contract

2.1. The presentation of artwork on the website does not constitute a legally binding offer, but an invitation to order.
2.2. By placing an order via email, telephone, or online form, the Client makes a binding offer to purchase the selected artwork.
2.3. The contract is concluded only upon my explicit acceptance, which is sent via email (order confirmation) or upon dispatch of the goods.  

3. Prices, Payment and Shipping

3.1. All prices are final prices. Due to the small business regulation or the special taxation for artists, the VAT is not separately shown. Shipping costs will be added and clearly indicated before the final order.
3.2. Payment is made in advance via bank transfer.
3.3. Goods will be dispatched only after full payment has been received. 

4. Delivery and Shipping

4.1. Delivery is made to the delivery address specified by the Client.
4.2. The shipping risk is not borne by the Artist.
4.3. If goods are delivered with obvious damage, the Client is asked to report this immediately to the delivery agent and the Artist.

5. Right of Withdrawal

Note: Mandatory for consumers within the EU.
5.1. Consumers have the right to withdraw from this contract within 7 days without giving any reason.
5.2. The withdrawal period is 7 days from the day on which the Client (or a third party named by them) takes possession of the goods.
5.3. To exercise the right of withdrawal, you must inform me (Krisztina Oláhné Balla, kriandalas@gmail.com) by means of a clear declaration.
5.4. Consequences of Withdrawal: If you withdraw, I will refund all payments received, excluding delivery costs, immediately. The Client bears the direct costs of returning the goods.  

6. Retention of Title and Copyright

6.1. The delivered goods remain the property of the Artist until full payment has been received.
6.2. The copyright remains exclusively with the Artist. Any reproduction, distribution, or use of the works for commercial purposes requires the explicit written consent of the Artist. The Client acquires the ownership of the physical work, but no intellectual property rights. 

7. Warranty and Liability

7.1. Statutory warranty provisions apply.
7.2. Minor color deviations between the photo on the website and the original artwork do not constitute a defect, as they are inherent in artistic creation.
7.3. The Artist is not liable for indirect damages or lost profits. Liability is limited to gross negligence and intent.

8. Data Protection

Personal data provided by the Client (name, address, email) will be processed in accordance with the GDPR and only for the purpose of contract execution.

9. Final Provisions

9.1. Austrian law applies, excluding the UN Sales Law (CISG).
9.2. The place of jurisdiction is the artist's seat in Austria.
